College Penalties

Blinn College District Policy Statement on Drug and Alcohol Use and Abuse

In accordance with the Drug-Free Schools and Campuses Drug Prevention Program Certification, the Blinn College District has adopted and implemented a program to prevent the unlawful possession, use, or distribution of illicit drugs/alcohol by students on school premises or as part of any of its activities. Blinn recognizes the importance of information about drug/alcohol abuse. Provided here, for the benefit of each student, are standards of conduct and legal and disciplinary sanctions for the unlawful possession or distribution of illicit drugs/alcohol.

Student

All Blinn students who violate this policy shall be subject to appropriate disciplinary action in accordance with Board Policy and the College Catalog. [See also Board Policy FM and FMA]

Students who reside within Blinn housing facilities and violate this policy shall be subject to appropriate disciplinary action in accordance with Board Policy, the College Catalog, and Residential Life Handbook. Residence halls and apartments are provided for students to live on-campus to pursue their educational programs. Blinn considers the residential life program an integral part of the resident student’s educational experience. It provides an opportunity for the student to experience group living and contributes to the student’s awareness of the rights of others. Failure to follow Blinn policies and procedures could lead to removal from the residence life program. [See also Board Policy FM and FMA] [See also Residential Life Handbook]

Such disciplinary action may include referral to drug and alcohol counseling or rehabilitation programs or student assistance programs, removal from resident life program, suspension, expulsion, and referral to appropriate law enforcement officials for prosecution.

Employee

In addition to the consequences established by federal law, a College District employee confirmed to have violated the College District’s policy pertaining to alcohol or controlled substances shall be subject to College District-imposed discipline, as determined by his or her supervisor(s) and the Chancellor. Such discipline may include any appropriate action from suspension without pay during the period of removal from safety-sensitive functions, up to and including termination of employment.

In cases where a driver is also employed in a nondriving capacity by the College District, disciplinary action imposed for violation of alcohol and controlled substances policies shall apply to the employee’s functions and duties that involve driving. Additionally, upon a recommendation of the employee’s supervisor, disciplinary measures up to and including termination of employment with the College District may be considered. Violations of this policy may result in disciplinary action in accordance with Board Policies DH(LOCAL) and DM(LOCAL). [See also Board Policy DHB]
